Aircraft Matters and the Law

Kalbian Hagerty LLP assists international and domestic clients with structuring aircraft purchase, sale, leasing and subleasing agreements and related registration, title and finance issues.


We work with clients from the initial stages of an aircraft purchase to final tender and acceptance of delivery to include assisting aviation clients with structuring aviation finance trusts, operating agreements.


When a client wishes to lease, sublease or sell aircraft, we work closely with the client and institutional investors to place or dispose of trust assets. These services include undertaking accelerator transactions to obtain title clearances for airframes and pooled engines, propellers and spares as well as negotiating charter and carrier agreements.


Kalbian Hagerty LLP works closely with international and domestic clients on aircraft registration matters to include registration on the U.S. Federal Aviation Administration (“FAA”) registry and the International Registry as well as coordinating registration, deregistration, ferry permits and insurance coverage.


As U.S. registered aircraft cannot be owned by non-U.S. citizens, we assist international clients in structuring companies, trusts and operating agreements which comply with FAA requirements so that the aircraft can remain on the U.S. registry whether permanently or temporarily based in the U.S. These trusts are especially useful if the aircraft requires maintenance, upgrades or modifications before export.
